Scotland’s LADHA ("we", “us”, “our”) are committed to protecting and respecting your privacy.

This privacy policy (“Privacy Policy”) together with our and Terms and Conditions and any other documents referred to therein, sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. For the purpose of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, (“GDPR”) or any subsequent amendment or replacement or supplementary legislation (together “Data Protection Law”), the data controller is Scotland’s LADHA of  1a Young Square, Livingston, EH54 9BX.

We may collect and process the following data about you:

1. Information you give us
You may give us information about you by filling in forms on our Site or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you register to use our Site, attend our events, subscribe to our newsletter, place an order on our Site, enter a competition, participate in discussion boards or other social media functions on our Site, promotion or survey, events and seminars and when you report a problem with our Site. The information you give us may include your name, address, e-mail address and phone number, financial and credit card information, personal description and photograph or country of residence.

2. Your IP Address
We use your IP address to help diagnose problems with our server and to administer the Site. Your IP address is also used to help identify you and to gather broad demographic information about you. Your IP address may also be used to assist in the detection of fraud and we may pass this information to the police.

4. How We Use Personal Information
Registration forms or order forms for our services, surveys and/or entry forms for our competitions and prize draws require you to give us personal information (like your name, address, date of birth, mobile number and/or email address).

Your personal information may be shared between PayPal, Stripe and us when you place an order for a particular service (for example if you are buying tickets for an event) in accordance with this Privacy Policy, Paypal's privacy policy and Stripe’s Privacy Policy.

Your personal information is used by us to contact you by post, phone or by electronic mail when necessary in connection with transactions, services or competitions entered into by you. We may also contact you relating to products and services from our partners, however, your information will not be supplied to them.

5. Carefully Selected Third Parties
If you opt in to receive information or offers from carefully selected third parties regarding their goods and/or services, we may provide your personal information to such third parties so that they may contact you by post or electronic mail with such information or offers.

6. How We Use Financial Information
Financial information that is collected is used to authorise payment and bill you for products and/or services that you purchase. When you make a purchase, your consent is given to provide your financial or personal information to those third parties necessary to process your transactions with us, credit card companies and banks. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction. Except as provided above, we will not share financial information with third parties without your prior consent.

7. Disclosure of Your Personal Information and Financial Information in Compliance with Laws
You should be aware that we may release your personal information or financial information when we believe it is necessary to comply with laws or regulations, to assist law enforcement, to enforce any terms under which you transacted with us on, or to protect our rights, property or safety and/or such rights of other users of the Site.

In the event that we are sold, or we transfer some of our assets to another party, your personal information could be one of the transferred assets. If your personal information is transferred, use of your personal information will remain subject to this Privacy Policy. Your personal information will be passed on to a successor in interest in the event of a liquidation or administration of Scotland’s LADHA.

9. How We Use Demographic Information
Demographic information is statistical data about our purchasers' age, gender, location etc. We use this demographic information to tailor our Site to the interests of our users. This information may be shared with advertisers only on an aggregate basis so that they can tailor their advertisements to the appropriate audience. "On an aggregate basis" means that your personal details would not be identifiable in the demographic information that we may use with advertisers.

12. Where we store your data
All our data is stored securely within the cloud. We utilise systems including Google Drive, Stripe, Squarespace and Paypal to do so. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. In particular, this means that your personal data will only be transferred to a country that provides an adequate level of protection (for example, where the European Commission has determined that a country provides an adequate level of protection) or where the recipient is bound by standard contractual clauses according to conditions provided by the European Commission (“EU Model Clauses”).

Our Site is accessible via the internet and may potentially be accessed by anyone around the world. This means that where you chose to post your data on our Site, it could be accessed from anywhere around the world and therefore a transfer of your data outside of the EEA may be deemed to have occurred. You consent to such transfer of your data for and by way of this purpose.

13. Protection of information

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted through Paypal or Stripe. Unfortunately, the transmission of information via the Internet is not completely secure. Although we will endeavour to protect your personal data, we cannot guarantee the security of your data transmitted to our Site. Any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

14. Your Rights

You have the right under Data Protection Law, free of charge, to request:

  • Access to your personal data held by us

  • Rectification or deletion of your personal data

  • A restriction on the processing of your personal data

  • Object to the processing of your personal data

  • A transfer of your personal data (data portability)

You can make a request in relation to any of the above rights by writing to us at the contact email address given at the end of this Privacy Policy. We will respond to such queries within 30 days and deal with requests we receive from you, in accordance with the provisions of Data Protection Law.

In practice, you will usually either expressly agree in advance to our use of your personal information for marketing purposes, or we will provide you with an opportunity to opt-out of the use of your personal information for marketing purposes.

You have the right to withdraw your consent to us processing your personal data, at any time, by writing to us at the contact address given at the end of this Privacy Policy. 

Where we process your personal data for marketing purposes, we will inform you and obtain your opt in consent (before collecting your personal data) if we intend to use your personal data for such purposes or if we intend to disclose your information to any third party for such purposes. If you change your mind about being contacted in the future, please click on the opt out options and we will remove you from our mailing lists.

16. Data retention

We retain personal data for as long as necessary for the relevant activity for which it was provided or collected. We retain this data in line with Paypal and Ticket Tailor's Data Retention Policy. If you are attending one of our events, we will retain this information after the event has finished. If you have opted-in to our mailing list, then we shall retain your personal information for marketing purposes, allowing you to keep up to date with Scotland’s LADHA, future events etc. We shall not retain financial information.

17. Updating Information
Please let us know if the personal information which we hold about you needs to be corrected or updated.

18. Changes to our Privacy Policy

Any changes we may make to our Privacy Policy in the future will be posted on this page and, when we make significant changes which affect your rights as a data subject, we will give you 30 days prior notice by email. Please check back frequently to see any updates or changes to our Privacy Policy. This Privacy Policy was last updated on 23rd of May 2018 and replaces any other Privacy Policy previously applicable from this date.

TERMS & CONDITIONS

BOOKING TICKETS - CONDITIONS OF SALE

Please read carefully.

Definitions:
In these terms, the following definitions apply:

  • “Company” refers to the organising company, ie. Scotland’s LADHA;

  • “Event” means any event organised by the Company;

  • “Venue” means any place where an event organised is held;

  • “Organiser” means any person who is responsible for organising an Event;

  • “Person” includes individuals, unincorporated bodies, government entities, companies and corporations;

  • “Scotland’s LADHA”, “we” or “us” means Scotland’s LADHA.

  • “Terms” means these terms and conditions;

  • “Ticket” means a valid ticket, wristband or other approved admission document giving the bearer the right to attend an Event.

Tickets are issued on behalf of the event promoter and/or the arena operator and are subject to the following conditions. If you fail to comply with these conditions then the arena operator shall be entitled to eject you from the venue and your ticket will become invalid. These terms and conditions govern your admission and conduct to the event. By entering, or attempting to enter, the venue, you agree to be bound by these Terms.

Tickets are issued subject to the rules and regulations of the venue and/or promoter including but not limited to the following:

  1. Please check your tickets as mistakes cannot always be rectified. Should a mistake have been made on your booking, please inform us as soon as possible via email to info@ladhascotland.com.
     

  2. If the event is postponed, the promoter and/or venue management will honour the ticket for the re-scheduled performance. It is the responsibility of the ticket holder to ascertain the date and the time of any re-scheduled event.
     

  3. The management reserves the right to refuse admission or to eject a ticketholder for behaviour likely to cause damage, injury, nuisance or failure to comply with the reasonable request of the management, and may on occasion; have to conduct security searches to ensure the safety of the patrons. Drunken behaviour or binge drinking will not be tolerated at any event.
     

  4. Tickets are sold subject to the management's right to alter or vary the programme due to events or circumstances beyond its control without being obliged to refund monies or exchange tickets.
     

  5. Ticket holders will be required to conform with our no smoking policy. It is illegal to smoke anywhere in the UK within indoor premises and anyone smoking will be asked to leave with no re-entry. Scotland’s LADHA. will not be held responsible for any expenses incurred due to the cancellation of an event. ie. travel expenses.
     

  6. Scotland’s LADHA accepts no responsibility for any personal property lost damaged or stolen.
     

  7. Ticketholders consent to filming, photography and sound recording as attendees of any event organised by Scotland’s LADHA. All attendees at the event consent to being filmed or recorded (images and sound) by or on behalf of us, the organiser or another authorised third party, and consent to their images (or likenesses) being used in any film, recording, photograph or other footage of the Event. All rights in the recording, photography or material shall be owned by the Organiser, authorised third party or us absolutely. You agree that any Recording may be used by us, the Organiser or authorised third party in any media and for any purpose throughout the world, including, without limitation, for promotional materials and activities, merchandise, or other commercial activities. No payment or compensation for use of your image or likeness shall be payable to you.
     

  8. Tickets shall not be used for advertising, promotions, contests or sweepstakes, unless formal written permission is given by the Scotland’s LADHA. In the event that such consent is obtained, the individual shall not use any intellectual property belonging to the company without prior consent.
     

  9. Scotland’s LADHA. reserves the right to cancel bookings which it reasonably suspects to have been made fraudulently.
     

  10. Unless paragraph 11 applies, Scotland’s LADHA. shall not have any further liability beyond the face value of the ticket purchased. Scotland’s LADHA shall not be liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the event which has been arranged by you are at your own risk.
     

  11. Nothing in these conditions of sale seeks to exclude any liability of the arena operator for death or personal injury caused by its negligence, fraud or other type of liability which cannot by law be excluded or limited.
     

  12. As these events are surrounding the sale of alcohol, all events are age restricted to 18+. Unless photographic proof of age is supplied, staff will make a judgement based on visual appearance prior to entry.
     

  13. The Organiser may make changes to the Event. The organiser reserves the right to alter or vary the scheduled or advertised Event in the event of an unforeseen circumstance or the occurrence of any event or circumstance beyond its control (a “Force Majeure Event”). Scotland’s LADHA shall not be liable for any damages, loss or disappointment arising from any alterations or changes made.
     

  14. All of these conditions of sale are governed by Scots Law and any disputes arising out of any transaction are subject to the exclusive jurisdiction of the English Courts.

 

COMPETITIONS

  1. Information on how to enter our competitions can be found detailed on our website on our Facebook page. Each competition will vary, so please be sure to read the information carefully.
     

  2. Competitions are only open to residents of the UK and are aged 18 or over. Competitions are not open to Scotland’s LADHA employees, friends or family members, or anyone professionally connected with the competition either themselves or through their families. The competition is open only to unpublished or non-professionals - writers, photographers - and submissions must not be published or featured anywhere else before
     

  3. Competition closing dates can be found on our website and / or on our Facebook page. Each competition will vary, so please be sure to read the information carefully. 
     

  4. By submitting an entry, you agree and warrant that (i) your entry has not been published before; (ii) your entry is entirely your own original work; and (iii) nothing in your entry is defamatory, private or an infringement of copyright or other intellectual property right or in anyway a breach of another's rights. Any breach of this clause will be disqualified from participating and winning the competition.
     

  5. One winner will be selected from the entries received in accordance with these terms and conditions based on the following criteria: information; relevance; originality; usefulness and writing skill.
     

  6. All entrants retain copyright in their entry. The winner of the competition grants the Company exclusive license to publish their entry, in whole or in part, on the Company's website and on their social media indefinitely. 
     

  7. There is no purchase necessary to enter.
     

  8. Only one entry per person allowed. Second or subsequent entries will be disqualified. Entries will not be accepted in bulk or on behalf of someone else. Joint submissions will be accepted. 
     

  9. By entering the competition you agree to be bound by these terms and conditions.
